Terms and Conditions of Use (T&C) – WPBLOGS.AI

These Terms and Conditions of Use (hereinafter the “Terms”) govern access to and use of the WPBLOGS.AI service, including the website, client interface, API, and associated WordPress plugin (hereinafter the “Service”).

By creating an account, installing the plugin, logging in, or using the Service, you acknowledge that you have read, understood, and fully accepted these Terms without reservation. If you do not agree to these Terms, you must not use the Service.

1. Definitions

  • “WPBLOGS.AI”: the publisher and provider of the Service.
  • “User”: any individual or legal entity using the Service.
  • “Account”: the personal space allowing access to the Service.
  • “Plugin”: the WordPress extension enabling access to the Service from the WordPress admin interface.
  • “Content”: any data provided, submitted, transmitted, generated, retrieved, or processed via the Service (prompts, texts, images, metadata, parameters, etc.).
  • “Public Website Content”: content and information publicly accessible on the User’s website (e.g., titles, categories, visible texts, pages accessible without authentication).
  • “Sub-processor”: a third-party provider processing data on behalf of WPBLOGS.AI (e.g., AI provider).

2. Purpose of the Service

WPBLOGS.AI provides AI-assisted content generation features, including:

  • generation of article ideas, outlines, and written content
  • image generation (e.g., featured images)
  • analysis of Public Website Content to improve suggestions
  • automation tools (e.g., scheduling publications), depending on available features

The Service is a support tool. It does not constitute legal, medical, financial, or professional advice of any kind.

3. Access to the Service, Account, and Mandatory Connection

Use of the Plugin and content generation/analysis features requires an active WPBLOGS.AI Account and a valid connection to the Service. Without an active connection, generation and analysis features are unavailable.

3.1 Account Creation

The User agrees to provide accurate information and keep it up to date. WPBLOGS.AI may refuse registration or suspend an Account in the event of clearly false or fraudulent information.

3.2 Authentication

Authentication is performed via a secure token-based mechanism. User credentials are used solely to generate an authentication token. Passwords are never stored in plain text.

3.3 Account Security

The User is responsible for maintaining the confidentiality of their credentials and for all activities carried out under their Account. In case of suspected unauthorized access, the User must notify WPBLOGS.AI immediately.

4. Data Transmission and Plugin Operation

4.1 Data Transmitted During Use

When the WordPress administrator logs in via the Plugin or triggers a generation request from the WordPress dashboard, the Plugin may transmit to WPBLOGS.AI, via encrypted HTTPS connection, some or all of the following information:

  • email address
  • authentication token
  • website URL
  • Public Website Content and public metadata (e.g., titles, categories, visible texts)
  • generation parameters (language, tone, length, keywords, instructions, etc.)

The Plugin is not intended to automatically collect personal data of website visitors. No visitor data is automatically transmitted without explicit administrator action.

4.2 Access Limitations

WPBLOGS.AI does not access non-public WordPress data (e.g., private content, user accounts, customer data, orders, etc.) without explicit User action and functional necessity. The User agrees to transmit only information they are legally authorized to process and share.

5. Artificial Intelligence, Sub-processors and External Processing

5.1 AI Processing

Content generation relies on artificial intelligence technologies. Depending on configuration and features, WPBLOGS.AI may rely on Sub-processors, including OpenAI, to process generation requests.

5.2 Transmission to Sub-processors

Content submitted for generation (prompts, instructions, public content, parameters) may be shared with Sub-processors strictly as necessary to provide the Service. Processing by Sub-processors is subject to their respective terms and privacy policies.

5.3 Temporary Storage and Deletion

Generated content may be temporarily stored on secure servers located in Switzerland for the sole purpose of delivering it to the User. Content is automatically deleted after retrieval, except where legal obligations, legitimate technical needs (e.g., fraud prevention, security), or explicit User requests apply.

6. Content, Rights, Licenses and Responsibilities

6.1 User-Provided Content

The User retains all rights to Content they provide. The User grants WPBLOGS.AI a non-exclusive, worldwide license limited to the duration necessary to host, process, and transmit the Content solely for the purpose of providing the Service.

6.2 Generated Content

Subject to applicable law and third-party rights, the User may use generated Content. WPBLOGS.AI does not guarantee originality, uniqueness, or suitability for any specific purpose.

6.3 Mandatory Verification

The User is solely responsible for reviewing and validating generated Content before publication or use, including but not limited to:

  • factual accuracy
  • legal and regulatory compliance
  • copyright, trademark, and image rights
  • absence of unlawful, defamatory, discriminatory, or misleading statements

6.4 Prohibited Uses

It is strictly prohibited to use the Service to:

  • generate or distribute illegal, hateful, defamatory, violent, or fraudulent content
  • circumvent technical or security limitations
  • mass scrape, attack, scan, or disrupt the Service
  • transmit sensitive or confidential data without legal basis or authorization

7. Intellectual Property

WPBLOGS.AI retains all intellectual property rights related to the Service, Plugin, API, software, infrastructure, trademarks, databases, and documentation. No rights are transferred except those expressly granted under these Terms.

8. Credits and Payments

The Service operates on a credit-based system. Pricing, usage limits, and quotas are described on the WPBLOGS.AI website or within the user dashboard.

Except where required by law, payments made are non-refundable. WPBLOGS.AI reserves the right to modify pricing and offers. Changes will apply at renewal or as otherwise indicated.

9. Availability and Maintenance

WPBLOGS.AI strives to ensure service availability but does not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, technical evolution, or incidents.

10. Suspension and Termination

10.1 Suspension by WPBLOGS.AI

WPBLOGS.AI may suspend or terminate access with or without notice in cases of:

  • violation of these Terms
  • abusive or fraudulent use
  • illegal activity
  • non-payment

10.2 Termination by User

The User may stop using the Service at any time and request account deletion in accordance with the Privacy Policy.

11. Limitation of Liability

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, WPBLOGS.AI disclaims all warranties, including fitness for a particular purpose and non-infringement.

WPBLOGS.AI shall not be liable for indirect damages, lost profits, loss of data, or consequences arising from the use of generated Content.

Total liability is limited to the amount paid by the User during the twelve (12) months preceding the claim.

12. Personal Data

Personal data processing is governed by the Privacy Policy. In case of conflict, the Privacy Policy prevails.

13. Amendments

WPBLOGS.AI may modify these Terms at any time. The applicable version is the one published at the time of use.

Affiliate Program

1. General Operation

WPBLOGS.AI offers an affiliate program allowing partners (“Affiliates”) to promote the Service in exchange for commissions on sales generated through their unique referral link.

When a user clicks on an affiliate link, a cookie may be stored on their device to track and attribute conversions correctly.

2. Cookies and Tracking

The affiliate cookie contains only tracking information (e.g., affiliate ID). It does not contain sensitive data.

The cookie validity period is set to 90 days and may be modified at any time without prior notice.

WPBLOGS.AI is not responsible for lost commissions due to:

  • cookie refusal
  • ad blockers
  • manual cookie deletion
  • technical limitations beyond its control

3. Commissions

Affiliates receive a commission of twenty-five percent (25%) of the net sale amount (excluding taxes) for each validated sale.

4. Payments

Commissions are paid monthly. Payments may be subject to identity or tax verification if required.

5. Abuse

Fraudulent, misleading, or illegal promotion practices are strictly prohibited. WPBLOGS.AI reserves the right to suspend accounts and cancel commissions in cases of abuse.

14. Governing Law and Jurisdiction

These Terms are governed by Swiss law. Any dispute shall fall under the exclusive jurisdiction of the courts at the registered office of WPBLOGS.AI.
